WORKERS COMPENSATION

Anytime someone is injured in the course of employment a claim for Workers' Compensation is indicated.

Workers Compensation claims are distinctive in the personal injury field as an injured worker need not prove any negligence or wrongdoing as the part of the employer, only that the worker has sustained an injury in the cause of his/her employment. In return, however, the claimants rights to monetary damages may be more limited than in other types of personal injury cases.

In cases where someone is injured due to the negligence of a third party, a negligence claim against the third party may be considered. Such claims are often possible in a construction accident case, as well as in other situations. In such instances, Connecticut law provides a system for coordination of the Workers Compensation and negligence claims.
